PROPERTY AUCTION

NOTICE OF LEVY AND SALE

            I, Mary Rajcula-Ongaro, collector of the Brookfield Water Pollution Control Authority, having made lawful demand for payment of sewer use and assessment charges due me as Collector for the Water Pollution Control Authority of the Town of Brookfield and payment thereof having been neglected and refused WILL SELL AT PUBLIC AUCTION the following properties pursuant to the provision of Sections 12-172, 12-157, 7-254 and 7-258 of the Connecticut General Statutes.

Said sale will occur on Thursday, January 7, 2021 at 3:00 pm at the offices of the Town of Brookfield, Room 135, located at the Brookfield Municipal Center, 100 Pocono Road, Brookfield, Connecticut.  The properties to be sold are as follows:

  1. 135 Heatherwood Drive, Stony Hill Village, Brookfield, Connecticut owned by 135 Heatherwood Drive, LLC to satisfy an unpaid sewer assessment in the amount of $14,203.91 and unpaid sewer use charges in the amount of $5,179.12. Said premises are more particularly described in an instrument recorded at Volume 656, Page 198 of the Brookfield Land Records.  The owner, mortgagees, lienholders and other encumbrancers of record whose interest will be affected and/or impaired by said sale are as follows:  135 Heatherwood Drive, LLC, Dean Vlahos and Stony Hill Village Condominium Association, Inc.   2. 3 Douglas Drive, Ledgewood Condominium, Brookfield, Connecticut owned by Judith A. Erickson to satisfy an unpaid sewer assessment in the amount of $10,864.92 and unpaid sewer use charges in the amount of $2,857.82Said premises are also known as Unit #20, Building 5 in said Ledgewood Condominium, Brookfield, Connecticut.  The owner, mortgagees, lienholders and other encumbrancers of record whose interest will be affected and/or impaired by said sale are as follows:  Judith A. Ericson, Ledgewood Association, Inc. and Emigrant Mortgage Company, Inc. [Sale Canceled]
  3. 63 Vale Road, Brookfield, Connecticut owned by Murphy Properties, Inc. to satisfy an unpaid sewer assessment in the amount of $39,715.03 and unpaid sewer use charges in the amount of $189.26. Said premises are more particularly described in an instrument recorded at Volume 310, Page 385 of the Brookfield Land Records.  The owner, mortgagees, lienholders and other encumbrancers of record whose interest will be affected and/or impaired by said sale are as follows:  Murphy Properties, LLC and K.L.C., Inc. d/b/a Keystone Leasing. The assessment amounts due as referenced above are inclusive the principal balance of assessment, and unpaid bond and delinquent interest charges accrued as of October 1, 2020.  The sewer use amounts due as referenced above are inclusive of use charges, lien fees and delinquent interest accrued as of October 1, 2020.  Additional bond and delinquency interest accrued on assessments and additional sewer use charges, interest, lien fees and delinquency interest accrued on use charges after October 1, 2020; together with all reasonable attorney’s fees and costs incurred in the collection of said unpaid sewer assessments and use charges shall also be collected as part of such sale.

With respect to each such sale, the premises will be sold SUBJECT TO taxes due the Town of Brookfield as of record may appear, water assessment liens in favor of the Town of Brookfield as of record may appear and subject to a six (6) month right of redemption as provided by Section 12-157 of the Connecticut General Statutes.

BROOKFIELD WATER POLLUTION CONTROL AUTHORITY

GENERAL TERMS AND CONDITIONS

OF LEVY & SALE PROCEEDINGS

            The following information is presented for the benefit of potential bidders at Brookfield Water Pollution Control Authority levy and sale proceedings for the collection of sewer use charges and benefit assessments:

  1. No representations are made as to the quality of title except that the parties listed as owners, mortgagees, lienholders or other encumbrancers in the Notice of Levy and Sale have been given notice in the manner required by statute.
  2. All bids will proceed in increments of One Hundred Dollars ($100).  The Water Pollution Control Authority will generally make an initial bid sufficient to cover the liability for assessments and use charges described in notice of levy and sale and the costs and expenses of the collection proceedings.
  3. The successful bidder will be required to deposit the sum of FIVE THOUSAND AND 00/100 DOLLARS ($5,000.00) by cash, certified or bank check at time of sale.  This deposit will be forfeited to the Water Pollution Control Authority in the event the successful bidder fails to promptly consummate the sale and pay the balance of the bid price.  The Water Pollution Control Authority reserves the right to waive this deposit requirement at time of sale.
  4. Sale shall be consummated within seven (7) days, with balance of bid price being paid by the successful bidder by bank or certified check.
  5. Deed of Conveyance will be tax collector’s form of deed.
  6. All properties are conveyed subject to taxes, if any, due or to become due to the Town of Brookfield and to water assessments, if any, due or to become due to the Town of Brookfield.
  7. All sales are subject to a six (6) month right of redemption which may be exercised by any person having an interest in the property.  During the redemption period the deed will be held by the Town Clerk but not recorded.  Additional special redemption privileges may exist in favor of the United States government (e.g. IRS liens).
  8. Purchaser at sale will not have right of possession until the end of the six (6) month redemption period.
  9. During the redemption period additional sewer use charges, municipal taxes and, if applicable, charges associated with municipal water assessments will accrue and if not paid by property owner or successful purchaser, will accrue interest and lien charges.
  10. If redemption occurs, the tax sale purchaser will be reimbursed the purchase price plus interest calculated at the rate of eighteen percent (18%) per annum.
  11. At the end of the redemption period, the deed will be recorded if no redemption occurs.
